Independent Legal Advice (ILA)
Independent Legal Advice is a certificate confirming that a party to a legal agreement has had their rights and obligations explained by a lawyer who represents only them — not the other side. ILA is commonly required in mortgage transactions, particularly when a guarantor is added to a mortgage or when a spouse is asked to consent to a transaction.
When ILA is commonly required:
- When a guarantor is signing onto a mortgage
- When a spouse is releasing interest in a matrimonial home
- When entering into a marriage contract or cohabitation agreement
- When a party is signing documents prepared by a lawyer for the other side
